Basic Policy on Protection of Personal Information concerning Customers, Business Partners, and Other Individuals

Nippon Electric Glass Co., Ltd (“the Company” or any of “we,” “us,” or “our”) manufactures and sells specialty glass products and glass manufacturing equipment. Recognizing the importance of protecting personal information pertaining to our customers, business partners, and other individuals handled by the Company during the course of our business activities, the Company will endeavor to protect personal information in accordance with the policy stated below. The policy for the handling of personal information related to employment management is prescribed separately.

In addition, please refer to the attachments for each country as the contents of such attachments may apply depending on the region in which our customers, business partners, or other individuals we handle reside or are otherwise located. In the case of any inconsistency between the contents of this policy (including the document titled “Notice on Disclosure Matters with respect to Personal Information of Customers, Business Partners, and Other Individuals under the Personal Information Protection Act” prescribed separately) (this “Policy”) and the contents of an attachment, the attachment shall prevail to the extent of such inconsistency.

  1. When handling Personal Information (means the information prescribed in Article 2, paragraph 1 of the Act on the Protection of Personal Information (the “APPI”); the same applies hereinafter), the Company will comply with laws and regulations related to the protection of Personal Information, including the APPI and the Act on the Use of Numbers to Identify a Specific Individual in Administrative Procedures (the “Numbers Act”), the obligations specified in guidelines issued by the Personal Information Protection Commission of Japan, and this Policy.
  2. The Company will specify the purpose of use of Personal Information as much as possible, and the Company will handle Personal Information only within the specified purpose of use, except in the case where the Company otherwise obtains the prior consent of the identifiable person (means the specific person identified by the Personal Information; the “Identifiable Person”) or in exceptional cases where Personal Information must be handled outside the defined purpose of use pursuant to laws or regulations. However, the Company will not use any Individual Numbers for any purpose other than the purposes of use disclosed publicly in advance.
  3. When obtaining Personal Information, the Company will obtain it by appropriate and fair means within the scope of the businesses we conduct and will announce the purpose of use thereof in advance, except in exceptional cases where the Personal Information must be handled outside the specified purpose of use pursuant to laws or regulations. Alternatively, the Company may announce the aforementioned purpose of use or notify the relevant Individual Person thereof promptly after acquiring the Personal Information. However, if Personal Information is obtained directly from an Individual Person in writing, the purpose of use will be specified in advance unless it is already evident in light of the conditions under which such information was obtained.
  4. The Company will seek to maintain the accuracy of and update the Personal Data it handles (means the personal data prescribed in Article 16, paragraph 3 of the APPI; the same applies hereinafter) within the scope of the purpose of use. In addition, the Company will appropriately manage such Personal Data and supervise its employees and contractors by implementing security control measures therefor (including “Organizational Security Control Measures,” “Personnel Security Control Measures,” “Physical Security Control Measures,” and “Technical Security Control Measures,” as well as measures such as “Ascertaining the External Environment” and the like).
  5. The Company will not provide Personal Data to any third party without the prior consent of the Identifiable Person, except in exceptional cases where Personal Data must be provided to a third party pursuant to laws or regulations
  6. In accordance with the provisions of relevant laws and regulations, the Company will accept requests from an Identifiable Person to disclose or correct, add to, delete, suspend use of, erase, or suspend provision to third parties of, the Personal Data the Business Holds (means the personal data the business holds prescribed in Article 16, paragraph 4 of the APPI; the same applies hereinafter), or to notify the Identifiable Person of the purpose of use of the Personal Data the Business Holds, disclose any Record of Provision to a Third Party (means the record of provision to a third party as prescribed in Article 33, paragraph 5 of the APPI; the same applies hereinafter), or provide information on matters regarding the measures taken for the secure control thereof.
  7. The Company will respond promptly and appropriately to any complaints from an Identifiable Person concerning the handling of their Personal Information, and the Company will endeavor to establish an internal system for this purpose.
  8. The Company will conduct appropriate internal audits with respect to the Personal Information that it handles, and will endeavor to continuously improve this Policy.

Notice on Disclosure Matters with respect to Personal Information of Customers, Business Partners, and Other Individuals under the Personal Information Protection Act

We hereby inform you of the prescribed matters regarding the Personal Information of customers, business partners, and other individuals that are stipulated under the APPI to be disclosed to the relevant Identifiable Person or to be readily accessible thereby. The Company will separately set out the prescribed matters regarding Personal Information related to employment management that are stipulated under the APPI to be disclosed to the relevant Identifiable Person or to be readily accessible thereby (the terms used herein have the same meanings as those in the “Basic Policy on Protection of Personal Information concerning Customers, Business Partners, and Other Individuals”).

  2. Purpose of use of Personal Information
    The Company will acquire the Personal Information that is necessary in conjunction with the provision of our products and services or in the course of executing our business for the following purposes of use, and we will handle the Personal Information within the scope required for these purposes.
    1. (1) Purposes of use related to business activities for the Company’s products and services
      1. (ⅰ) Manufacturing, design, processing, development, sales, installation, repair, and inspection services of the Company’s products
      2. (ⅱ) Various invitation and/or notification services for the Company’s new products, exhibitions, services, and surveys
      3. (ⅲ) Providing information on the Company’s products in accordance with the interests and preferences, etc. of an Identifiable Person
      4. (ⅳ) Analyzing an Identifiable Person’s use on the Company’s website regarding the Company’s products
      5. (ⅴ) Manufacturing, design, processing, development, sales, installation, repair, or inspection of machinery, devices, and equipment related to the Company’s products
      6. (ⅵ) Services based on a contract with an Identifiable Person or an organization to which the Identifiable Person belongs
      7. (ⅶ) Services relating to handling of applications or requests from an Identifiable Person
      8. (ⅷ) Verification services for an Identifiable Person
      9. (ⅸ) Services business operators are obligated to perform in accordance with laws and regulations, etc.
      10. (ⅹ) All other management and services related to (i) through (ix) above
    2. (2) Other purposes of use
      1. (ⅰ) Exercise of rights and performance of obligations under the Companies Act of Japan
      2. (ⅱ) Providing information to our shareholders
      3. (ⅲ) Providing information to companies engaged in securities agent services for handling shareholding
      4. (ⅳ) Providing information to, contacting, and sending notices to prospective employees (including for internships), and for our hiring selection process, processes for onboarding new employees, and other services related to our hiring activities
      5. (ⅴ) Sending information and inquiries from the Company to former employees
      6. (ⅵ) Responding to various inquiries from Identifiable Persons
  3. Purpose of use of Individual Numbers
    1. (1) Payment record preparation for consideration and fees, etc.
    2. (2) Distribution of dividends and surplus and payment record preparation for interest on funds
    3. (3) Payment record preparation for real estate rentals, etc.
    4. (4) Payment record preparation for the consideration for the acceptance of the transfer of property, etc.
    5. (5) Payment record preparation for commissions for real estate purchase and sale or lease transactions
    6. (6) Other work to be performed by the Company as an executor of matters to which Individual Numbers pertain, which fall under any of the provisions in Article 19 of the Numbers Act
  4. Matters related to joint use of Personal Data
    1. The Company will provide Personal Data to certain third parties for joint use in the exceptional cases described below. However, the Company will not make any Personal Data containing Individual Numbers available for shared use.
    2. Joint use between domestic and overseas subsidiaries (companies in which the Company holds more than 50% of the voting rights)
      The Company will jointly use the following Personal Data with its subsidiaries within the scope of the purpose of use specified in Section 2(“Purpose of use of Personal Information”) of this notice:
      1. Personal Data that contains an Identifiable Person’s name, names of his or her organization or employer, his or her title or role, the postal code of his or her organization or employer, his or her address, his or her telephone number, extension number, mobile phone number, facsimile number, or email address, or other items of information similar to the foregoing.
    3. Responsibility for the management of such Personal Data will rest with the Company. The address and the name of the representative of the Company are as stated above in “1. Business Operator Handling Personal Information.”
  5. Security control measures
    1. The Company will take the necessary and appropriate security control measures in order to manage the Personal Data and prevent any divulgence, loss, or destruction thereof. In addition, the Company will conduct the necessary and appropriate supervision of employees and contractors (including subcontractors and the like) who handle Personal Data. The main contents of the security control measures for Personal Data are as follows.
    2. Establishment of Personal Information Protection Policies
      1. In order to ensure the proper handling of Personal Data, the Company has established the “Basic Policy on Protection of Personal Information concerning Customers, Business Partners, and Other Individuals” and “Notice on Disclosure Matters with respect to Personal Information of Customers, Business Partners, and Other Individuals under the Personal Information Protection Act” policies with respect to compliance with relevant laws, regulations, guidelines, and the like and the establishment of a help desks to process complaints.
    3. Development of rules for handling Personal Data
      1. In order to ensure the proper handling of Personal Data the Business Holds, the Company will establish internal rules which stipulate the handling methods for such data in accordance with the stage of such handling (including the stages at which Personal Data is acquired, used, retained, provided, deleted or destroyed, and the like). The Company will endeavor to comply with these internal rules.
    4. Organizational Security Control Measures
      1. The Company shall establish a Personal Information Protection Office (the General Information Subcommittee’s Office of the Information Management Committee) for handling Personal Data. The Company shall also develop a system for reporting to and contacting the Personal Information Protection Office in the case where any employee becomes aware of APPI violations or the like.
    5. Personnel Security Control Measures
      1. The Company will conduct training for its officers and employees as necessary on points to note regarding the handling of Personal Data.
    6. Physical Security Control Measures
      1. The Company takes measures and the like in order to prevent the theft or loss of devices, electronic mediums, documents, etc. with which Personal Data is handled.
    7. Technical Security Control Measures
      1. In addition to restricting certain internal access, the Company has introduced initiatives in order to protect its information systems on which Personal Data is handled from unauthorized external access and the like.
    8. Ascertaining the External Environment
      1. When handling Personal Data outside of Japan, the Company takes security control measures therefor after collecting and ascertaining information regarding the personal information protection systems of the relevant countries.
  6. Procedures for responding to requests to disclose, correct, or delete the Personal Data the Business Holds
    1. (1) Contact Address

For requests to correct, add to, delete, suspend use of, erase, or to suspend provision to third parties of the Personal Data the Business Holds, or to disclose any Record of Provision to a Third Party of the Personal Data the Business Holds, notify the Identifiable Person of the purpose of use of the Personal Data the Business Holds, or provide information on matters regarding the measures taken for the secure control thereof (the foregoing, collectively, “Disclosure, Etc.”) please complete all of the required items in the “Request for the Disclosure of Personal Information Form” and mail it to the help desk at the address below (the sender is responsible for all postage). After verifying that the claimant in question is the Identifiable Person of the relevant information (or his or her legal representative), the Company will respond to the request in good faith within a reasonable timeframe. Please contact the help desk for any questions.

    2. (2) Method of verifying the Identifiable Person or legal representative thereof
      1. (ⅰ) For the Identifiable Person
        Mail a copy of an identification form issued by a public institution (one copy of either claimant’s “MyNumber” card, certificate of residence, driver’s license, health insurance ID card, or passport) to the help desk stated in 6. above (the sender is responsible for postage).
      2. (ⅱ) For the legal representative
        The abovementioned requests and complaints may also be submitted by the representative of the Identifiable Person. In such case, send the power of attorney with the seal registration certification for the seal of the Identifiable Person affixed thereto and one copy of identification for the Identifiable Person and for the representative issued by a public institution (one copy of either the “MyNumber” card, certificate of residence, driver’s license, health insurance ID card, or passport of the Identifiable Person and the representative) to the help desk stated in 6. above (the sender is responsible for postage).
    3. (3) Fees, etc.
      1. If the claimant desires to receive a paper copy of the written response for the disclosure of Personal Data the Business Holds, the disclosure of the Record of Provision to a Third Party of the Personal Data the Business Holds, or a notice of the purpose of use of the Personal Data the Business Holds, the Company will charge 839 yen (in the form of an 839 yen stamp) for each request. In such case, please send one 839 yen stamp per request along with the documents specified in (2) to the help desk stated in (1) above.
        *Please note that the Company will not return any postage fees or the fees mentioned above, even if the Company is unable to comply with your request for Disclosure, Etc.

    If the Company separately indicates to an Identifiable Person any separate purpose of use of the Personal Information, help desk contact information, or the like other than those stated above in any notice, terms of use, or other method approved by the Identifiable Person, such separate purpose of use or the like shall prevail over those stated in this notice. In addition, the Company may amend the content of this notice at any time as necessary to conform with any changes to the business of the Company, security improvements, amendments to relevant laws or regulations, and the like.
